Terms of Service

Parties. This agreement is between digitalforce360 OÜ (Estonian registry code 16940165, Narva mnt 5, Kesklinna linnaosa, 10117 Tallinn, Estonia), operating Ohana360, and the person or company that registers for the service (the "Tenant"). It is concluded by accepting it electronically at signup.

The service

Ohana360 provides a cloud-based, multi-tenant CRM and related business apps (sales, service, marketing, finance, knowledge base, HR and industry modules) as software-as-a-service. Ohana360 is a tool and infrastructure provider; it does not determine the content, accuracy or purpose of Tenant Data. Each Tenant gets an isolated organization.

Your responsibilities

You must provide accurate signup information and are responsible for account security and your users' actions. For personal data you enter into the service you act as data controller (under KVKK and, where applicable, the GDPR); Ohana360 acts only as data processor on your behalf (see the Data Processing Agreement). You must use the service in compliance with applicable law and with the Acceptable Use Policy (Turkish).

Fees and payment

Current list prices are published on the pricing page. Prices are set per app, add-on, industry edition and additional user on a monthly basis; unless agreed otherwise in writing, billing is annual and upfront for a 12-month term. Payments are collected through Stripe on a secure checkout page; card data is processed only by Stripe and is never stored on Ohana360 systems. Invoices are issued by digitalforce360 OÜ and applicable taxes may be added. Promotional prices apply for their announced scope and, once applied, stay fixed for that subscription term. Fees are non-refundable after the paid term starts, except where mandatory law provides otherwise; renewals and any price changes are communicated before the next term. Overdue accounts may be suspended after reasonable notice; data is not deleted during suspension. Demo organizations are valid for 14 days, after which they lock automatically. Every self-registered organization receives a 14-day free trial starting when its e-mail address is verified: during the trial every Marketplace app, add-on and industry edition can be added free of charge and no credit card is required. When the trial ends, Platform360 (Accounts, Contacts, Tasks) and all organization data remain accessible for free; paid apps added during the trial are deactivated, their data is kept, and they return unchanged once a subscription starts. Ohana360 may extend a trial at its discretion; one trial is granted per organization and accounts opened to obtain a second trial may be closed.

Intellectual property and your data

The software, design and trademarks belong to Ohana360; you receive a non-exclusive, non-transferable right to use the service. Tenant Data remains yours; Ohana360 processes it only to provide the service and never sells or rents it.

Warranty and liability

The service is provided "as is". To the maximum extent permitted by law, Ohana360 is not liable for indirect, incidental, special or consequential damages. Total liability is capped at the fees you paid in the 12 months preceding the claim (or 5,000 TRY during any free period). You are responsible for the content of Tenant Data and your use of the service.

Suspension and termination

Ohana360 may suspend or terminate accounts that violate these terms or the Acceptable Use Policy. You may close your account at any time; before termination you can export all your data with the in-app full export function, and on termination Tenant Data is returned or deleted per the Data Processing Agreement.

Changes, law and contact

These terms may be updated; significant changes are notified in advance. The agreement is governed by the laws of the Republic of Turkey; the courts and enforcement offices of Istanbul (Çağlayan) have jurisdiction. Notices: legal@ohana360.com
